Our Bankruptcy Practice

Chapter 7 Bankruptcy

In a Chapter 7 bankruptcy, also known as liquidation, you are allowed to permanently discharge certain unsecured debts, such as credit card balances and medical bills. Individuals or businesses may file under Chapter 7. We will help you determine whether you qualify and, if so, will make certain you know which debts can be discharged before you file. We will also ensure that any exempt assets, such as funds in a retirement account up to a stated amount, are excluded from your creditors.

Chapter 13 Bankruptcy

Under the 2005 bankruptcy law, if you have the means to repay your creditors over a 3 to 5 year period, you cannot discharge debts under Chapter 7, but must restructure or reorganize your debt under Chapter 13. Chapter 13 is available only to individual consumers, and is the choice of many consumers with secured assets such as homes and vehicles.

Chapter 11 Bankruptcy

A Chapter 11 bankruptcy petition allows a small business to reorganize and restructure debt, similar to Chapter 13. In some situations, where the amount of debt exceeds the limits set for Chapter 7 and Chapter 13, an individual consumer may be allowed to reorganize debt under Chapter 11.
